Driving Licence Exchange and Car Ownership in Marbella

If you are becoming a Spanish resident, your foreign driving licence may need exchanging. Here is what Marbella residents need to know about driving in Spain.

A car is not optional in most of Marbella. The residential areas are spread over a large geographic area, public transport outside the main town is limited, and the supermarkets, schools, golf courses, and social venues that form the infrastructure of daily life require a car to access efficiently. Understanding the practical reality of driving in Spain, and what happens to your home country licence when you become a resident, is a practical step for anyone buying property in Marbella with a view to spending significant time there.

Driving with a foreign licence as a visitor

As a visitor in Spain, most foreign driving licences from EU countries and many non-EU countries (including the UK, US, Australia, Canada, and others) are valid for driving. You can legally drive in Spain on your home country licence for as long as your visitor status permits. When you become a Spanish resident, the rules change.

EU nationals becoming Spanish residents

EU nationals registering as Spanish residents can continue to drive on their EU driving licence for the duration of its validity. When it expires, it should be exchanged for a Spanish licence. The exchange is straightforward and does not require a new test for EU licences from countries where the licence categories align.

UK nationals post-Brexit

UK nationals who registered as residents in Spain before 31 December 2020 typically had their UK licence automatically recognised. For UK nationals becoming residents after that date, the UK licence is not automatically exchangeable for a Spanish licence; Spain and the UK currently do not have a full licence exchange agreement in place (this situation may have changed, and should be confirmed with the relevant authority at the time of your registration). The practical implication is that some UK nationals becoming Spanish residents may need to take a Spanish driving test. Check the current position with the DGT (Dirección General de Tráfico) or a gestor.

Buying a car in Spain

Non-residents can buy cars in Spain (both new and second-hand). Registration of the vehicle requires an NIE number. Insurance for non-residents is available, though some insurers require a minimum number of months of recent driving history. If you are bringing a car from the UK or another country, temporary importation rules apply for visitors; permanent residents must register the vehicle in Spain and pay the relevant importation tax, which can be significant.

Driving habits in Spain

Spanish motorway driving is fast. Spanish road rules require mandatory equipment (warning triangles, reflective vest) to be in the car at all times. Speed cameras are widespread. Blood alcohol limits are lower than in the UK (0.25mg per litre of breath versus 0.35mg). The Guardia Civil conduct routine traffic stops and document checks. For new arrivals, taking the time to familiarise yourself with Spanish road rules specifically rather than relying on home country habits is worthwhile.

Frequently Asked Questions

Can I drive in Spain on my UK licence?

As a visitor, yes. As a resident, the position is more complex post-Brexit. Spain and the UK do not currently have a full licence exchange agreement, which means some UK residents in Spain may need to take a Spanish driving test. Check the current position with the DGT as this situation may evolve.

Do I need to register my car in Spain if I live there?

Yes, once you become a Spanish resident, vehicles used in Spain must be Spanish-registered. A foreign-registered car can be used temporarily as a visitor, but once you are a resident, using a permanently foreign-registered vehicle is not permitted. The process of importing and registering a foreign vehicle involves tax and administrative steps.

What mandatory equipment must be in a car in Spain?

Spanish law requires every vehicle to carry two warning triangles (to be placed 50 metres in front and behind the vehicle if you break down on the road) and a reflective vest to be worn when exiting the vehicle on the road. Failure to carry these can result in fines.
