After years of watching people buy property in Marbella, we have a clear view of the decisions that separate purchases that work out beautifully from those that come with regret. Here are the ten things we believe every buyer must get right.
1. Get your preparation done before you search
NIE number, Spanish bank account, lawyer instructed, and mortgage pre-approved if needed. Buyers who have this in place before the right property appears can move. Buyers who do not, lose properties to buyers who are ready.
2. Define your brief before you view
Know what you actually need versus what you think you might want. Budget, location priorities, minimum specification, must-haves versus nice-to-haves. A clear brief stops you wasting viewings on properties that are wrong for you, and helps you recognise the right one when it appears.
3. Choose an independent lawyer
Not the agent's recommended lawyer. Not the developer's conveyancing team. An independent qualified Spanish property lawyer whose only client in the transaction is you. This is not the place to save money.
4. Visit at different times
February and August feel very different in Marbella. A location that works in spring may have issues in summer you never saw. If you can visit the area and the specific property you are considering at different seasons, do it.
5. Get a survey on resale property
Spain does not require surveys. Buy anyway. An independent survey of a resale property is your protection against inherited problems. The cost is modest relative to the purchase price. What it finds may save you significantly more.
6. Read the community documents
The last two years of community meeting minutes tell you everything about the development: ongoing disputes, maintenance issues, financial health, neighbour dynamics. Ask for them before you make an offer.
7. Get tax advice before you complete
In whose name, what ownership structure, what residency status, what the tax position looks like in both Spain and your home country. This is done before you sign a private purchase contract, not after.
8. Do not stretch the budget beyond comfortable
Annual running costs, potential maintenance, rental income uncertainty, and the inherent illiquidity of property all argue for buying comfortably within your means rather than at maximum stretch. The property you can afford with some margin is safer than the dream property you can just about reach.
9. Check noise at night in summer
The single most common practical regret among buyers is noise from nearby venues, road traffic, or communal pool areas that was not apparent during daytime winter viewings. One evening visit in July tells you more than five daytime visits in March.
10. Make a Spanish will
Before you leave Spain with the keys in your pocket, instruct a Spanish lawyer to prepare a Spanish will covering your Spanish property. It costs a few hundred euros and takes care of a complicated succession situation that you never want your family to have to navigate. Do it.
