What is a power of attorney?
A power of attorney (escritura de poder notarial) is a legal document that authorises a named person to act on your behalf in legal and financial matters. In the context of buying property in Marbella, you would typically appoint your Spanish property lawyer as your attorney - allowing them to sign documents, apply for your NIE, open your Spanish bank account, and ultimately sign the title deed at the notario on your behalf.
Why buyers use power of attorney
International buyers often cannot travel to Spain for every stage of the purchase process. Visa restrictions, work commitments, or the timing of paperwork requirements can all make it impractical to be physically present. Power of attorney solves this. Once signed, your lawyer can handle everything in Spain while you manage the process from home.
How to grant power of attorney
If you are in Spain, you can sign a power of attorney at any Spanish notario. If you are in the UK or another country, you either visit a Spanish consulate or sign before a UK notary public, after which the document is apostilled (internationally certified) to give it legal validity in Spain. Your Spanish lawyer will tell you exactly what wording is needed for the document.
What the power of attorney covers
The document should specify exactly what actions your attorney is authorised to carry out. A well-drafted power of attorney for a property purchase typically covers: signing the purchase contract, signing the title deed at completion, applying for your NIE, opening a bank account, paying taxes, and registering the property. Your lawyer will draft it to cover everything you need.
Is it safe?
Yes, provided you are using a reputable, regulated Spanish property lawyer. The power of attorney is specific in what it covers and does not give unlimited authority. Your lawyer's professional insurance covers their actions taken on your behalf. This is an entirely normal and widely used mechanism for international property purchases in Spain.

Can I revoke a power of attorney?
Yes. A power of attorney can be revoked at any time by signing a revocation document. If you appoint a lawyer and then change your mind about using them, you can revoke the original power of attorney and appoint a different representative.
